This Privacy Policy (âNotice) applies to Personal Information collected through Oscar Health websites and mobile applications (âSitesâ), including www.hioscar.com or on any other website or mobile app or any other interaction that you may have with Oscar that this Notice is posted on, unless otherwise modified by another notice. (together, the âServicesâ).
Please read this Notice carefully. At Oscar, we know that we have a lot of information about you and want to be sure that you understand the information we collect, how we use such information and your rights related to the information.
By using or accessing the Services in any manner, regardless of whether you register or create an Account, you acknowledge the terms of this Notice and those within our Terms of Service as well as any additional Site Specific Terms, as applicable. Any terms we use in this Privacy Policy without defining them have the definitions given to them in the Terms of Service.
Health Information
In some circumstances, our collection and use of Personal Information is subject to the requirements of the Health Insurance Portability and Accountability Act (âHIPAAâ). Identifiable member and patient information we collect will be treated as Protected Health Information (âPHIâ) through the Services and the applicable Notice of Privacy Practices will apply and supersede this Notice in the event of any conflict. Our Information Practices
Personal Information We Collect
We may collect information that describes or relates to you and is classified as Personal Information or Personal Data under applicable state laws (collectively, âPersonal Informationâ).
Personal Information does not include:
- Publicly available information as defined under applicable state laws.
- De-identified or aggregated information as defined under applicable state laws.
- Other information excluded from the applicable state laws, including, but not limited to, Personal Information governed by HIPAA.
In the past 12 months, we may have collected these categories of Personal Information:
- Direct and Personal Identifiers, such as name, email, user name and password, your mailing address, your tax identification number or social security number;
- Demographic Information, such as date of birth and gender;
- Commercial Information, such as transaction information and purchase history
- Payment or Banking Information, such as payment card information, bank account number;
- Internet or Electronic Network Activity, such as such as browsing history, interactions with our website, Internet Protocol (IP) address, Media Access Control (MAC) address; operating system and version; Internet browser type and version (for more information, see the Cookies and Other Tracking Technologies section, below);
- Geolocation Information, such as device location;
- Audio, Visual or Other Information, such as call and video recordings;
- Professional or Employment-Related Information, such as place of employment and job title;
- Inferences, such as conclusions that we develop about you using the data set forth above; and
- Sensitive Personal Information. Of the information listed above, geolocation, your Social Security or Driverâs License number, your login and password information for certain Services, may also qualify as sensitive Personal Information.
The provision of the sensitive Personal Information listed above is voluntary. In certain instances, we will not be able to process your request for our Services without the requested sensitive Personal Information.
How we Collect your Personal Information
We collect your Personal Information in the following ways, pursuant to applicable law:
- Directly From You, such as when you use our Services, register for an account, contact us, respond to a survey, sign up to receive emails, text messages, and/or postal mailings;
- Through Our Use of Cookies and Other Automatic Data Collection Technologies, such as when you visit our websites, use our mobile applications, open or click on emails we send you, or interact with our advertisements. We, or third parties we work with, automatically collect certain information using technologies such as cookies, web beacons, clear GIF, pixels, internet tags, web server logs, and other data collection tools. - From Our Third Party Partners, such as third parties that we have partnered with to provide you the Services that you have requested from us. This may include our vendors, joint marketing partners and social media platforms.
- Other Sources, such as data analytics providers or publicly available sources. We may also obtain information from our affiliates.
Use of Your Personal Information
We may use the Personal Information to:
- Provide our products and Services, such as responding to your requests, managing accounts and providing related customer and technical support;
- Personalize your experience for our Services, such as communicate with you about products and services that may be of interest to you and provide you with location-based information;
- Provide Marketing and Advertising, such as to send you information about our Services, such as offers, promotions, newsletters and other marketing content, offered by Us or our third-party partners;
- Provide and administer your participation in surveys and research, events, contests and programs;
- Improve our business, such as analytics and research purposes that will help us operate, evaluate, develop, manage and improve our business, including operating, administering, analyzing, and improving our Sites; developing new products and Services; managing and evaluating the effectiveness of our communications; conducting market research, aggregating and anonymizing data, and performing data analytics; and performing accounting, auditing, and other internal functions;
- Provide Security and Protection of the Services and the Company, such as activities to protect against, identify, and respond to suspected fraud, criminal activity, violations of law or our Terms and other policies, or any harm to our staff or any other individual;
- Comply with laws and legal obligations, such as to enforce applicable legal requirements, relevant industry standards, contractual obligations, and our policies, including this Notice, and our Terms and Conditions;
- Support general business and operations needs, such as to consider mergers, acquisitions, reorganizations, bankruptcies, and other business transactions such as financings, and related to the administration of our general business, accounting, auditing, compliance, recordkeeping, and legal functions; and
- Support Business Transfers. To implement mergers, acquisitions, reorganizations, and other business transactions, and where necessary to the administration of our general business, accounting, recordkeeping, and legal functions.
We may use Artificial Intelligence (AI) Technology when processing your Personal Information as described above. This may also involve de-identifying or anonymizing your Personal Information to train, optimize, ground or otherwise enhance our AI Technology, including disclosure to third parties who help us develop or provide the systems to enable the AI Technology.
We also may use the personal information we obtain in other ways for which we may provide specific notice at the time of collection or otherwise with your consent.
How we May Share your Personal Information
We may disclose Personal Information to operate our business and provide support for our services, provide communications and advertise or market our Services, respond and comply with legal requests, or with your Consent.
We may disclose Personal Information with the following categories of third parties:
- Service Providers: These authorized third parties perform services on our behalf and provide products to Us. These may include, for example, cloud / IT services, data storage, sales, analytics, marketing, consultants, auditors and legal counsel. We require these Service Providers by contract to protect your Personal Information.
- Affiliated Companies: We may disclose such Personal Information to subsidiaries, affiliates, or joint ventures as needed to provide our products and Services and in general to operate our Company.
- Third-Party Ad Networks and Providers. We may disclose Personal Information to third-party ad network providers, sponsors and/or traffic measurement services. These third parties may use cookies, JavaScript, web beacons (including clear GIFs), and other tracking technologies to measure the effectiveness of their ads and to personalize advertising content to you. These third-party cookies and other technologies are governed by each third party's specific privacy notice, not this one. To exercise your choices about receiving third-party ads, see the âTracking and Advertising Choicesâ section below.
- Corporate Transactions: We may disclose your Personal Information in connection with a proposed or actual corporate merger, acquisition, consolidation, sale of assets, bankruptcy, insolvency, or other corporate change.
- With whom you direct Us to share, upon request or when you consent.
- Other Third Parties: We may disclose your Personal Information to legal, governmental, or judicial authorities, as instructed or required by those authorities or applicable laws, or in relation to a legal activity, such as in response to a subpoena or an investigation. We may also disclose such Personal Information if we believe disclosure is necessary to prevent physical, financial, or other harm, injury, or loss.
- Other Disclosures Required by Law. We may disclose your Personal Information for legal reasons, such as to (a) follow laws, (b) enforce our agreements, (c) prevent fraud or security issues, (d) protect our company, our users and the public as permitted by law, (e) handle legal claims and investigations and take action regarding possible illegal activities or a violation of our policies.
Retention
We retain your information as long as reasonably needed for the purposes described within this Notice or otherwise described to you at the time of collection. For example, we will retain your Personal Information for as long as we believe it is necessary to comply with our legal obligations, resolve disputes, enforce our Terms of Service and other agreements, or to protect the rights, property or safety of Oscar, our employees, our users or others.
Cookies and Other Tracking Techniques
Automated Technologies
Like many other websites and online services, we collect certain information by automated means. It helps us analyze and improve the services we provide you. We do this by using cookies, pixels, web server logs, web beacons and other similar technologies implemented on our website and mobile app.
A âcookieâ is a text file that websites send to a visitorâs computer or other Internet-connected device to uniquely identify the visitorâs browser or to store information or settings in the browser. A âweb beacon,â also known as an Internet tag, pixel tag or clear GIF, links web pages to web servers and their cookies and may be used to transmit information collected through cookies back to a web server.
We may use these technologies to collect information about your device (e.g., computer, mobile phone), browsing actions, and usage patterns. The information we obtain in this manner may include your device IP address, identifiers associated with your devices, types of devices connected to our services, web browser characteristics, device characteristics, language preferences, referring/exit pages, clickstream data, and dates and times of website visits (collectively, âOnline User Activityâ).
These technologies help us (1) remember your information so you will not have to re-enter it; (2) track and understand how you use and interact with our Services; (3) tailor our Services around your preferences; (4) measure the usability of our Services and the effectiveness of our communications; (5) provide customer support; and (6) otherwise manage and enhance our Services and marketing activities.
Your browser may be configured to alert you when receiving certain types of cookies or enable you to restrict or disable certain types of cookies. Our Sites are not designed to respond to âdo not trackâ signals received from browsers. Third Party Analytics:
We use third-party web analytics services on our Services, such as Google Analytics. The service providers that administer these services use automated technologies to collect data (such as IP addresses, cookies, and other device identifiers) to evaluate use of our Sites. These services generally keep Online User Activity anonymized and/or operate under confidentiality terms in regard to the handling of personal information.
Third Party Advertising
We may use certain cookies known as third-party advertising cookies or âTargeting Cookiesâ as well as other advertising techniques (that do not involve Protected Health Information) to share limited identifying information including Online User Activity with advertising partners to provide you with advertising about products and services tailored to your interests. You may see our ads on other websites or mobile apps through this technique, since it enables us to target our messaging to users considering demographic data, usersâ inferred interests and browsing context.
In similar fashion, ad technology companies track usersâ online activities over time by collecting information through automated means, including through the use of cookies, web server logs, web beacons and other similar technologies. This information is used to show ads that may be tailored to individualsâ interests, to track usersâ browsers or devices across multiple websites, and to build a profile of usersâ online browsing activities. The information collected may include data about usersâ visits to websites that participate in the online ad ecosystem, such as the pages or ads viewed, and the actions taken on the websites. This data collection takes place both on our Sites and on third-party websites that participate in the online ad ecosystem. This process also helps us track the effectiveness of our marketing efforts. You can opt-out of Targeting Cookies on our Sites by doing the following:
- Select âYour Privacy Choicesâ link at the bottom of our website page;
- Select âTargeting Cookiesâ and use the toggle button to block third party advertising cookies;
- Select âConfirm My Choices.â
Please note that you may need to opt-out separately on each browser and device this way. In addition, our Sites endeavor to process âGlobal Privacy Controlâ (GPC) signals from web browsers by automatically opting-out users from Targeting Cookies, although GPC technology is not fully developed and it is not yet supported by all browsers.
Choices Available to All Individuals
You can use certain features of the Services without registering, thereby limiting the types of information that we collect. You can always opt not to disclose information to us, but keep in mind some information may be needed to register with us or to take advantage of some of our features. See the Cookies and other Technologies for information on how all Users can update their automated website collection settings.
Updating your Account Information
If you have registered for the Services, you may be able to add, update, or delete certain Personal Information in your Account. When you update information, we may need to maintain a copy of the unrevised or deleted information in our records. Registered users may change their password and update the information that they provide to us, such as address, contact information and health information. Users can make updates by going to the settings page of their Account at hioscar.com. In some cases, registered users may need to contact the appropriate state or federal health insurance exchange to update their information.
If you choose to use a bank account to make payments through the Services, we collect and store your bank account information. If you use a payment card to make payments through the Services, that information is collected and stored by our third party payment processing companies (the âPayment Processorsâ). We may change our preferred Payment Processors from time to time. Use and storage of that information is governed by the Payment Processorâs applicable terms of service and privacy policy. However, we may from time to time request and receive some of your financial information from our Payment Processor for the purposes of completing transactions you have initiated through the Services, enrolling you in discount, rebate, and other programs in which you elect to participate, protecting against or identifying possible fraudulent transactions, and otherwise as needed to manage our business.
Updating Your Communications Choices
To the extent permitted by law, and if you have provided your contact information to us, we may store and use that information to contact you by various means, including regular mail, email, telephone including voicemail, or SMS/MMS (text message).
- Email: Each marketing email we send to you contains an unsubscribe link so that you can opt-out of receiving future commercial emails from Us. If you do not wish to receive additional marketing emails from Us, click the unsubscribe link and follow the instructions to unsubscribe your email address. If you have unsubscribed but continue to receive email from Us, contact us. Unsubscribe requests may take up to 7 - 10 days to process. You will have the ability to opt out of any marketing or advertising communications, but we may still need to send you communications relating to your Account for purposes important to the Services, such as password recovery or a payment reminder.
Email, like all non-encrypted Internet email communications, may be accessed and viewed by other Internet users, without your knowledge and permission, while in transit to us. For that reason, to protect your privacy, please do not use email to communicate information to us that you consider confidential. If you wish, you may contact us instead by telephone.
- SMS / MMS: By voluntarily opting to have text messages sent directly to your mobile phone you agree to our Text Messaging Terms and Conditions. We may also use your information to notify you about payment information and/or to communicate with you about your Account. You will have the ability to opt out of any marketing or advertising communications, but we may still send you communications relating to your Account for purposes important to the Services, such as password recovery or a payment reminder.
Security
We maintain administrative, technical, and physical safeguards designed to protect personal information against accidental, unlawful, or unauthorized destruction, loss, alteration, access, disclosure, or use. No data transmission or storage is 100% secure, and we cannot guarantee that information you send to us online or via email, or information that we maintain about you, will not be accessed, disclosed, altered, or destroyed. We will make any legally required disclosures of any breach of the security, confidentiality, or integrity of your personal information.
Registered users must use a unique username to access their Account information through www.hioscar.com or the Oscar mobile application. Do not give this username and password to others. You must prevent unauthorized access to your Account by selecting and protecting your username and password and/or other sign-on mechanism appropriately and limiting access to your computer or device and browser.
State Specific Notices
Note: Oscar is subject to federal privacy laws under HIPAA as described in our Notice of Privacy Practices, and it is therefore not subject to certain state privacy laws that exempt HIPAA-regulated organizations and/or HIPAA-covered information. However, we provide individuals with privacy rights that may be exercised in accordance with our HIPAA Notice of Privacy Practices, and additionally provide certain access, correction and opt-out services as described in Cookies and other Technologies and as otherwise described in this Notice.
State-Specific Consumer Rights
This Section is provided specifically for residents of California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Minnesota, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah and Virginia. In addition to the disclosures and rights provided above in this Notice, you may be entitled to exercise certain requests regarding your Personal Information as described below, subject as noted above to some exceptions that apply to us as a HIPAA-regulated organization and/or in regard to HIPAA-covered information.
Access, Correction and Deletion Rights
You may request a copy of the following: (1) the categories of Personal Information we collected about you; (2) the categories of sources from which the Personal Information is collected; (3) the business or commercial purpose for collecting or selling (if applicable) the Personal Information; (4) the categories (or in some states, the identity) of third-parties with whom we shared Personal Information, and the categories of Personal Information shared; and (5) the specific pieces of your Personal Information that we have collected, used, disclosed, or sold.
You may request that we (and our service providers) correct your Personal Information if it is inaccurate or delete your personal information. Note that deletion requests are subject to certain limitations, for example, we may retain Personal Information as permitted by law, such as for tax or other record keeping purposes, to maintain an active account, to process transactions and facilitate customer requests, and for certain other internal business purposes described in our Notice.
Before submitting any request, please note the following important information:
- You may directly access much of your personal information if you have an account with us by logging in to the Services and visiting your account page (e.g., contact information, profile). Likewise, you may directly correct some of your Personal Information on your account page.
- If you are submitting a deletion request, your account will be permanently terminated and personal information on that account will be deleted consistent with any applicable laws. Once your deletion request is processed: (i) you will lose the ability to log into our Services (ii) you will be able to open a new account in the future, but you may not be able to tie the new account to any past activities.

Opt-Out Rights
You have the right at any time to opt out of (i) any selling or sharing of your personal information to a third-party (excluding service providers or other exceptions permitted by law); (ii) any third-party targeted advertising (i.e., cross-context behavioral advertising); and (iii) any use of sensitive personal information (such as precise geo-location or financial information) except for the purposes it was collected and as otherwise permitted by law.
As described above, certain identifying information with Online User Activity may be shared with brands/services we partner with, advertising businesses and other third-parties through Targeting Cookies or other means.
You are entitled to opt-out of these and other activities (some of which are referred to as a âDo Not Sellâ right):
- Any selling or sharing of your personal information to a third-party (excluding service providers or other exceptions permitted by law);
- Any third-party targeted advertising (i.e., cross-context behavioral advertising); and;
- Any use of sensitive personal information (such as precise geo-location information) except for the purposes it was collected and as otherwise permitted by law, such as with your consent.
As provided above in the Cookies and other Technologies section, (i) anyone can opt-out of Targeting Cookies on our Sites or rely on an automated GPC signal from the browser, and (ii) update âYour Privacy Choices,â which can be found on the footer of this Site. Privacy laws may provide you with other opt-out rights which are inapplicable to us. In particular, we do not engage in impactful profiling activities with respect to our online users.

Verifying and Processing Requests
To help protect your privacy and maintain security, we will take steps to verify your identity before granting you access to your Personal Information or complying with your request. You will be required to provide some information, based on the nature of your request, including, but not limited to: name, email, home address, date of birth, phone number, or account information. In addition, if you ask us to provide you with specific pieces of personal information, we will require you to sign a declaration under penalty of perjury that you are the consumer whose Personal Information is the subject of the request. If you designate an authorized agent to submit a request on your behalf (a) we may require you to provide the authorized agent written permission to do so, and (b) we may require you to verify your own identity directly with us as described above.
Appeals
If we deny a privacy request, you may appeal the decision to us at the contact information provided below or in our denial notice. To the extent possible, please describe the basis for your appeal and if there is any specific personal information that concern you. We will endeavor to provide a prompt response and within the timeframe provided by any applicable law.
If you are unsatisfied with our response to an appeal, you can raise your concerns with your stateâs Office of the Attorney General.
Additional information regarding requests
We may not, and will not, discriminate against any customer for exercising their privacy rights, including those provided by the applicable privacy laws. Please note that we may otherwise continue to share your Personal Information with our affiliates and service providers, and as otherwise directed by you, for the purposes described in our Notice.
To the extent permitted by applicable law, we may charge a reasonable fee to comply with your request.

California Residents: Site Users

As described near the top of this Notice, during at least the last 12-month period, we may have collected all of the above categories of personal information about you from the following categories of sources: (i) Directly from you, such as when you provide us information; (ii) From your device(s), such as when you visit our website(s); (iii) Third parties who perform services on our behalf; (iv) Our joint marketing partners; (v) Online advertising companies; and (vi) Consumer data resellers.
We may use Personal Information as described above near the top of this Notice, which includes:
- Performing services to you, including as necessary maintaining or servicing accounts, providing customer service, processing, or fulfilling orders and transactions, verifying customer information, processing payments, maintaining and improving our Services to you, or providing similar services â all categories of information.
- Marketing research and activities, as well as auditing interactions with you and concurrent transactions, including, but not limited to, providing advertising or marketing services to you, providing analytics services, counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance â primarily including identifiers, protected classifications, commercial information, online activity, geolocation data and inferences.
- Short-term, transient use, including, but not limited to, the contextual customization of ads shown as part of the same interaction â primarily including identifiers, commercial information, online activity, geolocation data and inferences.
- Detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity â primarily including identifiers, commercial information, online activity, geolocation data and sensory information.
- Debugging to identify and repair errors that impair existing intended functionality â primarily including identifiers, online activity and geolocation data.
- Undertaking internal research for technological development and demonstration â primarily including identifiers, commercial information, online activity, geolocation data and inferences.
- Undertaking activities to verify or maintain the service or safety of a service or device that is owned, manufactured, manufactured for, or controlled by us, and to improve, upgrade, or enhance the service or device that is owned, manufactured, manufactured for, or controlled by us â primarily including identifiers, commercial information, online activity and geolocation data.
- The following information may be shared for a legitimate business purpose or legal requirement with our legal affiliates, contracted vendors who perform services on our behalf, professional services organizations, such as auditors and law firms, and government entities (where required by law) â all categories of information.
- The following information may be âsoldâ or âsharedâ with third parties (as such terms are defined under applicable state privacy laws) such as marketing partners, online advertising services, third party data analytics providers, social networks and/or consumer data resellers â primarily identifiers, commercial information, online activity, (non-precise) geolocation data, and inferences. These activities are primarily to engage in online advertising activities and provide tailored content and ads that may be of interest to you. You have the right to opt out of this disclosure of your information, as detailed above.
We do not sell or share information about individuals between 13-16 years old without affirmative authorization to do so, if we have actual knowledge of the individualâs age. As noted above, we do not knowingly collect or use information from minors under 13 without parental consent.
California Residents: Job Applicants, Workforce and Business Partners
Privacy rights apply to all individuals (not just Site users), including job applicants, current and former employees, contractors and business partners. Due to the nature of these relationships, the collection and use of personal information can vary, but in general terms and in addition to all the disclosures above:
- Job applicants may provide us with personal information as part of an employment application and review process that includes the applicantâs contact information, education and employment history, resume and cover letter. We do not use this information for any purpose other than to evaluate the individual for employment with us and manage our careers program. Job applicants may provide additional information for routine background checks to a third-party provider of such services, under specific privacy terms and consents that will be provided at the time of collection.
- Employees receive information that provides additional details regarding our employee privacy practices.
- We collect contact information and other personal information reasonably necessary to engage and work with contractors and business partners in the course of a business relationship.
All such individuals who are California residents can request additional information about our privacy practices with respect to their information, as well as make the access, deletion, correction requests here and opt-out requests here, updating their cookies preferences by selecting the âYour Privacy Choicesâ on the footer of the website or by contacting us at 1-855-672-2755.
Residents of Nevada Only
For Nevada residents, please note that we do not sell personal information as defined by Nevada law (Nevada Revised Statutes, Chapter 603A, Section 1.6). You can submit a request to us regarding the sale of such information as directed by the contact information provided below.
Residents of Washington (and other states with health data laws)
Please note that Oscar does not draw inferences about consumersâ health statuses based on purchases or other personal information it collects as described in this Policy.
